Algeria Asserts Its Sovereign Rights, Rejects Unilateral Expulsion of Algerian National by France

Algiers, Algeria | January 14th, 2025 — In a strong demonstration of its sovereign rights, Algeria has refused to accept the unilateral expulsion of an Algerian citizen, known as “Doualemn,” by French authorities. The 59-year-old influencer, who had been residing in France for 36 years, was deported without the usual legal and diplomatic processes, prompting Algeria to take a firm stand against the violation of his fundamental rights. The expulsion, carried out without prior notification to the Algerian government, has sparked a diplomatic dispute between the two nations, with Algeria rejecting the actions as arbitrary and illegal.

Dr. Omar Hetatache, a legal expert and political analyst, praised Algeria’s decision to exercise its sovereignty and ensure the protection of its citizens. He emphasized that Algeria’s response was rooted in a steadfast commitment to international law and the protection of its citizens’ rights, irrespective of their location. “Algeria exercised its sovereign right to block the expulsion process of this citizen, reaffirming its commitment to respect and uphold international conventions,” stated Dr. Hetatache.

Violation of International Conventions and Legal Rights

Algerian authorities have expressed outrage over the violations of the 1974 Algerian-French Consular Convention, which mandates the protection of Algerian nationals abroad. The Algerian Ministry of Foreign Affairs issued a statement condemning the French actions, noting that the Algerian government was not informed of the arrest, detention, or expulsion of the individual involved. The statement also highlighted the breach of fundamental legal rights, including the right to be informed in advance and the right to contest an expulsion decision in court.

The expulsion was deemed an “unjustified and hasty” action by France, according to the Algerian Ministry, which pointed out that the individual, a legal resident in France for over 15 years with a family, should have been given the opportunity to challenge the expulsion. French authorities, however, acted swiftly to avoid legal scrutiny, with the influencer’s lawyer accusing the French government of “rushing the expulsion” to prevent the case from being reviewed by a judge.

Algeria’s Commitment to Justice and Bilateral Relations

In its measured response, Algeria chose to prioritize justice over escalation, allowing the individual to return to France under fair and just conditions. The Algerian government reiterated its commitment to bilateral relations with France, based on mutual respect, adherence to agreements, and the protection of citizens’ rights. “This stance reflects Algeria’s dignity as a sovereign state and its unwavering adherence to principles of justice and fairness,” Dr. Hetatache remarked, underlining the country’s dedication to resolving conflicts through dialogue, rather than political maneuvering.

Algeria’s rejection of the expulsion also serves as a reminder that the rights of its citizens cannot be compromised by political interests. The response highlights the legal foundation for Algeria’s position, rooted in bilateral agreements between the two countries, such as the 1968 accord regarding the free movement of Algerian citizens and their families in France. Dr. Hetatache emphasized that the expulsion violated these agreements, particularly as it circumvented the legal process that mandates a minimum 15-day notice for such actions.

The French Response and Diplomatic Tensions

The French Ministry of Foreign Affairs responded with its own statement, expressing its intent to maintain an open dialogue with Algeria. However, Dr. Hetatache criticized the French response, asserting that it failed to address the legal issues raised by Algeria. “The French response failed to provide a solid legal counterargument to the points raised by Algeria. Instead, it suggested that Algeria had closed the door to negotiations, which is not the case,” he remarked.

The diplomatic standoff highlights the complexity of Algerian-French relations, which are marked by sensitive issues such as historical memory, the rights of Algerians in France, and the management of migration flows. Dr. Hetatache noted that despite differences, it is essential for both countries to collaborate on common challenges. “It is crucial for both Algeria and France to engage constructively on these issues to ensure long-term stability and cooperation,” he concluded.

As this diplomatic issue continues to unfold, it underscores Algeria’s determination to protect the rights of its citizens while reaffirming its commitment to justice and international legal standards.
