Council of the Nation: Interior Minister Saïd Sayoud Details New Legislative Framework for Political Parties

ALGIERS, March 16th, 2026 — On Sunday, the Minister of Interior, Local Assemblies, and Transport, Saïd Sayoud, presented before the Council of the Nation the draft organic law governing political parties, marking a decisive step in the consolidation of Algeria’s democratic institutions.
The session provided an opportunity for members of the Commission on Legal and Administrative Affairs, Human Rights, Local Organization, Territorial Planning, and Administrative Division to pose questions and offer observations regarding the draft legislation, reflecting a collaborative and consultative approach to lawmaking.
Minister Sayoud emphasized the strategic significance of the law, noting that it establishes one of the principal pillars regulating political life and partisan activity in Algeria. “The draft organic law on political parties, adopted by the members of the People’s National Assembly, represents a robust framework enabling parties to operate more efficiently within a structured legal environment,” he stated. He added that the law will empower parties to fulfill their constitutional role in citizen mobilization, elite formation, political socialization, and fostering public trust in political institutions—thereby contributing decisively to the consolidation of the democratic process. The minister also highlighted that President Abdelmadjid Tebboune has closely overseen the development of the text as part of his initiative to regulate political practice on solid constitutional, legal, and institutional foundations.
The draft law aligns with the 2020 Constitution, expanding constitutional guarantees for political practice and establishing clearer rules for the exercise of pluralism while respecting national constants, unity, and societal principles. Sayoud noted that experience under the previous organic law, n°12-04 of 12 January 2012, revealed practical deficiencies and implementation challenges, necessitating comprehensive reform.
The legislation seeks to create a clear legal framework that enables political parties to reorganize their internal affairs in accordance with democratic principles, rotation of responsibilities, transparency, and accountability. By doing so, it aims to reinforce societal trust in democratic institutions, consolidate state stability, and enhance the credibility of political practices. The law further establishes mechanisms to govern interactions between parties and the administration, streamlining communication and procedures within a transparent and lawful framework.
The draft organic law, comprising ninety-seven articles divided into seven chapters, introduces several innovations to modernize the regulation of partisan life. It balances the rights and obligations of political parties, ensures their freedom to operate both on the ground and in the media, and guarantees the possibility of judicial recourse against administrative decisions. Sayoud underlined that the law strengthens the party’s institutional role, promotes digital management of party records via a dedicated Interior Ministry platform, and addresses political opportunism by prohibiting elected officials from changing party affiliation during their mandate under penalty of automatic dismissal.
The legislation also codifies the effective participation of women and youth, mandating a minimum 10% representation among founding members and enhancing access to leadership roles. It revises the procedures for creating and accrediting parties to address previous gaps, enshrines democratic principles in internal organization and leadership elections, limits the tenure of party heads to a five-year term renewable once, and requires the establishment of permanent local structures across all wilayas to strengthen presence and representativeness.
Furthermore, the law places a strong emphasis on ethical political conduct and governance, promoting transparency, accountability, and anti-corruption measures. It regulates organizational changes within parties, clarifies notification procedures, deadlines for review, and judicial recourse, while also allowing the formation of alliances to enhance electoral participation and the merging of accredited parties to form more coherent and effective political formations. Financial transparency is reinforced, including prohibition of foreign funding, mandatory disclosure of donations, and annual financial reporting. Provisions also allow for temporary suspension of party activity following a prior warning and revision of dissolution procedures for parties failing to present candidates in two consecutive elections. Penal and transitional provisions facilitate alignment of party statutes and internal regulations with the new law.
Minister Sayoud concluded that the draft organic law establishes a comprehensive, modern framework designed to strengthen Algeria’s democratic institutions, ensure effective political party operation, and promote stability, accountability, and public confidence in the political process.
