Justice Reform in Motion: Draft Law on Conflict Tribunal Presented to Algerian Senate

Justice Minister Lotfi Boudjemaa outlines key provisions of the new organic bill aimed at modernizing the Tribunal of Conflicts and ensuring legal certainty in line with the 2020 Constitution.

Algiers, Algeria | June 10th, 2025 — In a step toward judicial reform and constitutional alignment, Algeria’s Minister of Justice and Keeper of the Seals, Lotfi Boudjemaa, presented on Tuesday a detailed briefing before the Council of the Nation on the draft organic law concerning the organization, functioning, and jurisdiction of the Tribunal of Conflicts. The presentation took place during a plenary session chaired by Azouz Nasri, President of the Council, and attended by Kaouter Krikou, Minister of Relations with Parliament.

 

This draft law represents a strategic update to the existing 1992 organic legislation and aims to resolve shortcomings that have hindered the tribunal’s full operational potential. It also reflects Algeria’s evolving constitutional framework, particularly following the adoption of the 2020 Constitution, which underscores the need for a more dynamic, accessible, and digitally adaptive judicial system.

Minister Boudjemaa emphasized that the primary objective of the proposed legislation is to empower the Tribunal of Conflicts—tasked with resolving jurisdictional disputes between judicial and administrative courts—to carry out its role more efficiently, with a focus on procedural simplification and legal clarity for litigants.

Key Innovations Introduced by the Draft Law:

One of the cornerstone features of the bill is the standardization of appointment procedures for bench judges and State Commissioners assigned to the Tribunal of Conflicts, ensuring consistency and institutional coherence.

In a significant leap toward digital modernization, the draft law authorizes litigants to submit petitions either in paper or electronically, aligning with broader efforts to digitize the judiciary and enhance citizen access.

Another major reform involves extending the term of office for the President of the Tribunal—from three to five years—a duration also applicable to judges. This measure is designed to promote the stability of case law and foster deeper institutional expertise.

Additionally, the proposed law introduces new legal remedies, including requests for interpretation and applications to correct material errors in rulings issued by the tribunal. It also grants the tribunal president the authority to correct purely material mistakes—further streamlining the appeal process and reinforcing judicial transparency.

These proposed measures fall squarely within the government’s broader strategy of modernizing Algeria’s judiciary, reinforcing its independence, and enhancing its effectiveness, in accordance with the directives of President Abdelmadjid Tebboune.

Tribute to Late Senator Mostefa Boudina:

The session commenced with a solemn tribute to the late Mostefa Boudina, a moudjahid, former senator, and president of the National Association of Former Death Row Inmates. Council Speaker Azouz Nasri invited members to observe a minute of silence, extending condolences to the late senator’s family, comrades, and colleagues.

In closing, Speaker Nasri congratulated Minister of Religious Affairs and Endowments, Youcef Belmehdi, on Algeria’s recent international recognition with the “Labeitom” Gold Award, which honors the country’s exemplary organization of the Hajj season. This distinction, he noted, stands as a testament to the meticulous efforts made under the guidance of President Tebboune.
