In a brazen display of geopolitical predation, Washington and Rabat have inked an agreement that exposes the cynical exploitation of Western Sahara. Cloaked in euphemisms like โstrategic cooperationโ and โsecuring supply chains,โ this pact opens the door for American companies to plunder mineral resources from a territory that, under international law, belongs to no one but its indigenous Sahrawi population.
According to Africa Intelligence, the agreement grants privileged access to several strategic deposits, including Twihinate, Lamlaga, and Glibat Lafhouda โ sites rich in rare earths, niobium, vanadium, gold, and molybdenum. These minerals are critical for defense industries, aerospace, batteries, and drone technology.
Yet behind the bureaucratic language of โeconomic partnership,โ this deal flagrantly circumvents a core principle of international law: the people of Western Sahara alone hold the right to determine the fate of their land and its resources. The territory remains on the United Nations list of non-self-governing territories since 1963, pending decolonization. Any third party, including an occupying power, has no legal authority to exploit its wealth without the express consent of the Sahrawi people.
By granting concessions as if the Moroccan state possessed full sovereignty, Rabat not only defies the UNโs longstanding position but also disregards multiple international and European judicial rulings affirming that Sahrawi resources cannot be exploited without the peopleโs approval.
The economic stakes are immense. The Moroccan National Office of Hydrocarbons and Mines (ONHYM), in partnership with firms like Managem and the phosphate giant OCP, is already exploring several sites. Twihinate alone contains substantial concentrations of rare earths and niobium, metals indispensable to military and aerospace industries, with industrial extraction slated for 2028.
Two models are under consideration: joint ventures between Moroccan and American firms, or Moroccan companies extracting minerals solely to sell to American buyers. Regardless of the approach, Washingtonโs objective is clear: secure access to critical resources while preventing Chinaโs influence from expanding into the global strategic metals supply chain.
But no amount of geopolitical justification can erase the stark legal reality: Morocco has no recognized sovereignty over Western Sahara. Exploiting the territoryโs resources without the consent of its people is a direct violation of international law. Precedents abound โ in 2017, South African authorities seized a ship carrying phosphates from Western Sahara, demonstrating the rising legal and political risks surrounding Sahrawi resources.
This pact reveals a calculated attempt to convert a non-autonomous territory into a mere reservoir of strategic minerals. By exploiting Western Sahara economically, Rabat hopes to create a fait accompli capable of influencing the political resolution of the conflict.
Yet international law is unequivocal. Until the Sahrawi people exercise their right to self-determination, no decision regarding their natural wealth can be legitimate without their explicit consent. Any action to the contrary will inevitably face mounting legal, diplomatic, and political challenges.
