๐“๐“ต๐“ฐ๐“ฒ๐“ฎ๐“ป๐“ผ โ€“ ๐“™๐“ช๐“ท๐“พ๐“ช๐“ป๐”‚ ๐Ÿ๐ŸŽ๐Ÿ๐Ÿ” โ€“ย Despite clear and binding rulings by the Court of Justice of the European Union (CJEU), the European Union has once again chosen to move forward with negotiations with Morocco on a new fisheries agreement. EU Member States have formally granted the European Commission the green light to relaunch talks with Rabat, reviving a cooperation framework that the Court had explicitly invalidated for violating international law.

 

In 2024, the CJEU ruled unequivocally that the EUโ€“Morocco fisheries and agricultural agreements breached the fundamental right of the people of Western Sahara to give their consent. The territory, a former Spanish colony, has been largely occupied by Morocco since 1975 and continues to be recognized by the United Nations as a non-self-governing territory awaiting decolonization. The Courtโ€™s decision left little room for interpretation: any exploitation of the territoryโ€™s natural resources without the free and genuine consent of the Sahrawi people is unlawful.

 

Yet, in open disregard of this ruling, the European Commission opted in late 2025 to amend the existing agricultural agreement in an attempt to render it โ€œcompliantโ€ with the Courtโ€™s judgment. It is now preparing to go even further by initiating negotiations on an entirely new fisheries agreement, including a so-called โ€œsustainable fisheries partnershipโ€ and a protocol granting European vessels access to waters under Moroccan control.

 

The previous fisheries protocol expired in 2023, leading to the official suspension of EU fleet activities in those waters. Prior to its expiration, internal EU data revealed that more than 90% of European catches under the agreement were made in the waters of Western Saharaโ€”a figure that starkly illustrates the extent to which these agreements relied on the exploitation of resources from a territory over which Morocco holds no internationally recognized sovereignty.

 

The decision to revive negotiations raises serious questions about the European Unionโ€™s commitment to its own legal obligations. By authorizing talks with Rabat without any clear mechanism to ensure the free, prior, and informed consent of the Sahrawi people, Brussels appears willing to subordinate international law to economic interests and diplomatic convenience.

 

This approach is openly supported by Europรชche, the main lobbying group representing European fishing interests, which has urged the Commission to break what it calls the current โ€œdeadlock.โ€ The organization cites shrinking alternative fishing zones, tighter regulations in European waters, and unsustainable practices by certain third countries. However, this economic narrative deliberately sidesteps the central issue: the illegality of exploiting the natural resources of Western Sahara.

 

Far from being a neutral economic initiative, the renewed negotiations effectively legitimize Moroccoโ€™s policy of occupation and faits accomplis. They reinforce the impression of a persistent European double standardโ€”one that invokes international law selectively, championing it when politically expedient and diluting or ignoring it when it becomes inconvenient.

 

For the Sahrawi people, this development only deepens a long-standing grievance: once again, their land and resources are being negotiated over without their participation or consent. Under the guise of economic cooperation, the status quo of colonial exploitation is perpetuated. Until Sahrawi consent is recognized as a non-negotiable prerequisite, any new agreement will remain legally vulnerable, politically illegitimate, and morally indefensible.
