Algeria Publishes New Organic Law on Political Parties, Setting Compliance Deadlines

Algeria has published its new organic law governing political parties in the Official Gazette, following its adoption by both houses of parliament in March.

The legislation sets out the conditions for the creation, organisation and operation of political parties. Article 4 states that a legally accredited party may exercise its activities freely, within the framework of constitutional provisions, the democratic and republican character of the state, and existing laws and regulations.

Article 5 requires parties to adhere, in their establishment and activities, to national constants, including the values and components of Algeria’s identity in its three dimensions—Islam, Arabity and Amazighity—alongside the nation’s history, the principles of the 1 November 1954 Revolution and its founding proclamation, as well as national unity, territorial integrity, and the interests, symbols and attributes of the state.

Under Article 95, parties already compliant at the time of publication must update their statutes at the first congresses held after the law enters into force. Those deemed non-compliant are given six months to regularise their status, failing which they face judicial dissolution.
