Djamaa El-Djazair Issues Fatwa on Borrowing for Eid Al-Adha Sacrifice

Algiers — Djamaa El-Djazair has issued a religious opinion regarding the ruling on borrowing money to purchase a sacrificial animal for Eid Al-Adha, which Muslims are set to celebrate at the end of the month, according to a statement published on its official website on Thursday.

The fatwa states that Islamic scholars are unanimously agreed that borrowing for the purpose of performing the sacrifice is not permitted for those who are unable to repay the debt, due to the potential hardship and harm it may cause.

However, it clarifies that borrowing is permissible for those who have sufficient means or strong indications that they will be able to repay the debt, without falling into financial hardship.

The ruling further explains that the sacrifice (Udhiyah) is among the visible rituals of Islam and a confirmed Sunnah according to the majority of scholars, intended to express devotion and the glorification of Almighty Allah’s rites. However, Islamic law is founded on ease and the removal of hardship, and therefore it is not required for a believer to burden themselves beyond their capacity.

The statement cites scholarly consensus that borrowing is prohibited when repayment is unlikely, as this may expose individuals to financial strain, noting that Islamic law is based on preventing harm and hardship.

For those who expect to be able to repay and have reasonable means to do so, scholars differ: some Maliki jurists consider borrowing permissible and even recommended in order to revive the Sunnah, while others discourage it to avoid debt obligations.

The fatwa concludes that there is no harm in borrowing for those who are reasonably confident in their ability to repay and wish to perform the sacrifice, expressing hope for reward and blessing for those who uphold this religious practice.
